Website Access Agreement

This website is owned and operated by B+C Intuitive Services (hereafter referred to as "the company"). These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors access to our art gallery and storefront, as well as booking for various services. By accessing or using the website of our service, you indicate that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Website Operability

High speed internet and an updated browser are highly recommended to ensure smooth site functionality. Best efforts have been made to ensure the website is accessible on most platforms, however, the company cannot guarantee the site will be operable on all browsers and devices. If you are having irresolvable technical issues with the website, please notify us at CustomerSupport@evolutionarybiz.com.

Purchase of Goods and Services

All goods and services provided by the company are presented "as is", with no warranty, expressed or implied.

Bookings

Service bookings are refundable with cancellation notice received with at least 24 hours notice prior to the scheduled time. Bookings within 24 hours are considered confirmed and are non-refundable. Any emergency occurrence that results in the company cancelling or being unable to attend the appointment will result in a full refund for the client. Please allow up to 7-10 business days for processing refunds on our end, with potential further delays related to card/payment processors.

Return Policy

No returns on art. All art sales are final.

Art Products

Due to the nature of art, some pieces may include light scuffs, tears, dirt marks, hair, or other contaminants that may, or may not, be accurately reflected in the art preview images available in the gallery. While we make our best efforts to sell the best kept and maintained art possible, and to represent each piece accurately in our gallery, it is always possible that slight inconsistencies may occur.

Prints are printed with a modern Epson Ink-Jet laser printer on Glossy Photo Media paper in High Quality resolution. We stand behind the quality of our prints and ensure that every step is taken to provide the best reproduction possible. All prints include an authentic signature on the back by the artist.

Shipping Details

Prints are shipped in protective sleeves, with chipboard insert. Originals will often involve more customized packing and shipping (generally paid for by the company, as orders over $100 include free shipping). Prints and originals DO NOT include frames, unless otherwise noted in the item description.

At this time, we only offer priority mail flat rate shipping in the US. We also offer priority mail international shipping, which will vary depending on region and the weight of the art. Most pieces are of negligible weight, but there may be some pieces that incur additional weight costs.

Right to Change/Modify Offerings/Terms

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Intellectual Property Rights

The company, website, service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of the company, it's owners, and/or any affiliate creator(s). Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof, without express written permission from the company.

Free Business Consultations

We aim to offer meaningful services at a reasonable price, and, as described in the services section, it takes a bit of back and forth to see what we can do for your unique situation. As such, we aim to offer free preliminary consultations to assess next steps. However, this is a courtesy service, and we reserve the right to refuse or decline to honor this service, or any pending free consultation meeting, at anytime, for any reason.

Solicitation by the clients is strictly forbidden in these consultations, as they are only meant for us to present our potential services and prepare quotes. If it appears a prospective client is attempting to pitch a product/service, or otherwise attempting to sell to us during these sessions, the meeting will be immediately terminated, and the violating party shall be permanently blocked from our systems. If you would like to send an offering of services for our business, please feel free to do so through more appropriate channels (contact forms, email, postal mail).

AI Usage Disclosure Statement

While laws governing the disclosure of AI use are still variable, and often non-existent entirely, the company believes passionately in AI use transparency and clear disclosure in an age where misrepresentation by AI agents, or those who deploy them, is of rising concern. No one should be unclear of whether they are engaging with an AI agent, or content written or made with the use of AI. If these tools are to be used, they must be used responsibly. As such, we enclose a brief statement on our use of AI tools herein.

The company acknowledges that we use AI SEO, marketing, blog writing and social media tools. All other website content and design does not employ AI.

We do not currently use AI for customer service tickets or requests, choosing instead to provide personal, human interaction and customer support services.

Indemnification

You agree to indemnify and hold the company, it's owners, and affiliates harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services or products offered on the website.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the company be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service or products provided.

To the maximum extent permitted by applicable law, the company assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service or products; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to Modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional Emails and Content

You agree to receive, from time to time, promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

Legal Dispute Resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Siskiyou County, California, without respect to its conflict of laws and principles. Any and all such claims and disputes shall be brought in to, and you hereby consent to them being decided exclusively by, a court of competent jurisdiction located in Yreka, California. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
